§Legal
Terms of Service.
Effective . Last updated .
These Terms govern access to and use of Agora (the “Service”), including the boards, project pages, profiles, comments, reactions and the paid brand board. By using the Service, making an account, posting a project or paying for a brand slot, you agree to these Terms and to the Privacy Policy.
If you do not agree, do not use the Service.
Operator and contact
The Service is operated by Parthix Advisory UG (haftungsbeschränkt), Petzetstraße 21, 81245 München, Germany (“we”, “us”, “our”). The legally required provider details are on the imprint. Legal notices, takedown requests and brand enquiries go to ZoDevAi.work@gmail.com.
What the Service is
Agora is a place to publish things you built with AI and have them seen. Anyone can look without an account. Posting needs one, and is free.
There are two kinds of board and they do not mix. The people's boards, covering today, this week and all time, rank posts by views. A view is a first visit or a return visit, from anyone, whether or not they have an account. No fee, boost or promotion can place anything on those boards or move it up. The brand board is separate, marked as paid, and ranked by clicks.
Posting does not buy you traffic, views, customers, revenue, a rank, a duration on a board, or any other result. Boards recompute regularly and positions change. We may alter, pause or discontinue boards, ranking rules, categories and features.
Eligibility
- You must be at least 13 to use Agora.
- If you are under 18, you may use Agora only with the permission of a parent or legal guardian. They must agree to these Terms on your behalf and they are responsible for what you do here.
- Some countries set a higher minimum than 13 for a service like this one. Germany, for example, treats 16 as the age from which a young person can agree to this kind of data processing without a parent. Where the law where you live sets a higher age, that age applies to you.
- Paying for a brand slot is different: you must be 18 and able to enter a binding contract, or acting for a company you may bind. “You” then includes that company.
- You may not use the Service if the law of Germany, the European Union or another applicable jurisdiction prohibits it, including trade sanctions.
Your account
Keep your sign-in details to yourself. Anything done through your account is treated as done by you. Tell us promptly if you think someone else has access. One person should hold one account; accounts made to inflate views, reactions or comments are a breach of these Terms. You can delete your account at any time, and everything attached to it goes with it.
What you post
You keep ownership of what you post. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, resize, format and publicly display it on the Service and in ordinary promotion of the Service, for as long as needed to run it and keep an archive. You also grant visitors the right to see it there.
By posting, you confirm that:
- You built the thing, or you are authorised to publish it. Posting someone else's work as your own is grounds for removal.
- You hold the rights to everything in the post, including images, and to the link it points at.
- The post and its destination comply with the law, including advertising, consumer, privacy and intellectual property rules.
- You are not impersonating another person, brand or company.
- The destination is not malware, phishing or a scam.
- What you submit is accurate, and you will keep it accurate.
Views, ranking and manipulation
Rank on the people's boards is views, and views are only worth something if they are real. You may not inflate them or help anyone else do so. That includes scripted or automated requests, click farms, paid or traded views, refresh loops, multiple accounts, and any method whose purpose is to make a post look more visited than it is.
We count views with the safeguards described in the Privacy Policy, we may change how counting works at any time to keep the boards honest, and we may discount views we believe are not genuine. Where we find manipulation we may reset a count, remove a post, or close the account, without refund where money was involved.
The brand board
A brand may pay a set fee to be listed on the brand board. One price, no auction, no bidding against other brands. Once listed, position on that board is decided by clicks and by nothing else.
- Brand rows are advertisements. They are not editorial picks, reviews, endorsements or independent rankings, and they are marked as paid.
- A fee buys a listing on the brand board for the period stated at checkout. It does not buy clicks, traffic, customers, revenue, a fixed position, exclusivity, or a place anywhere on the people's boards.
- You may only list a product you own or are authorised to represent, and the site you link to must show valid, current operator details identifying who is legally responsible for it. Missing, false or unverifiable details are grounds for removal.
Payments and refunds
Brand payments are handled by Stripe. Card details go to Stripe and never to us: we do not see, collect or store full card numbers. Stripe's own terms and privacy notice apply to the payment itself. Prices and any applicable tax are shown before you pay.
Listing is a digital service that begins as soon as payment is confirmed and the row appears on the board. By completing checkout you ask us to start it immediately and accept that you lose any statutory right of withdrawal to the extent the law allows that waiver. Where a mandatory consumer right cannot be waived, we honour it.
Beyond that, payments are final. Being outranked, receiving fewer clicks than hoped, downtime, or removal for breach of these Terms does not create a refund. Reversing a payment without a legal basis is a breach of these Terms, and we may remove the listing and refuse further use of the Service.
Prohibited content and use
You may not post, or use the Service for:
- Anything unlawful, fraudulent, defamatory, harassing, hateful or violent, or that exploits children.
- Sexual or pornographic material, or links to chat, invite or messaging groups.
- Link shorteners or redirects used to hide where a link really goes.
- Counterfeit goods, unauthorised streaming, or other infringement of copyright, trademark or other rights.
- Offers requiring licences you do not hold, including financial, medical, gambling or weapons-related offers.
- Interfering with the Service: scraping beyond ordinary browsing, bypassing rate limits, probing security, or reverse engineering except where mandatory law allows it.
Our right to remove
We may refuse, hide, edit, recategorise or permanently remove any post, comment, profile, brand row or account, with or without notice, where we believe these Terms or the law may have been broken, where a rights holder or platform complains, or where something creates legal, security or reputational risk. Removal does not entitle you to a refund.
Complaints and rights notices
If you believe something on Agora infringes your copyright, trademark or other rights, or is unlawful, email ZoDevAi.work@gmail.com with: your name and contact details; the address of the post on Agora; the destination it links to; what the problem is; and a statement that your notice is accurate and that you are the rights holder or authorised to act. We may restrict the post while we look at it, and we may pass the notice to the person who made it. Repeated or abusive notices may be ignored.
No endorsement
A place on a board is not our opinion of anything. We do not check that posted projects work, that claims about them are true, or that they are safe to use. View and click counts describe what our systems recorded, not a promise of any outcome. Links from the Service lead to sites we do not control and are not responsible for.
To show a post we may fetch and display public information about what it links to, such as a title, description, icon or preview image. We use that only to identify the thing being posted, not as our own brand, and it does not imply any affiliation with or endorsement by its owner.
Availability and changes
The Service is provided as it is. It may be unavailable, slow or wrong. We may change these Terms; if a change matters, we will update the date at the top of this page. Continuing to use the Service after a change means you accept it. For a payment already made, the Terms in force at checkout keep applying to that payment, except where the law or a security risk requires otherwise.
Disclaimers
To the fullest extent the law permits, we exclude all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure or free of errors, or that posts, names, images, ranks or counts are accurate or complete.
Limitation of liability
We do not limit liability that the law says we cannot limit, including for intent, gross negligence, injury to life, body or health, or under mandatory product liability rules. Subject to that:
- We are not liable for lost profits, lost data, lost goodwill, substitute services, or other indirect, incidental, special or consequential damage.
- For slight negligence we are liable only for breach of duties essential to these Terms, and only for typical, foreseeable damage.
- Our total liability for a claim about a payment is limited to what you paid us for the listing that claim concerns in the three months before it.
Indemnity
You will defend and indemnify us and the people working on the Service against claims, damages, losses and reasonable legal costs arising from what you posted, the site it links to, your payment, your breach of these Terms, or your infringement of someone else's rights. We may take over the defence of a claim, and you will cooperate.
Governing law
These Terms are governed by the law of the Federal Republic of Germany, excluding its conflict of law rules. If you are a consumer with mandatory local protections that cannot be displaced, those still protect you. If you are not a consumer, the courts of München have exclusive jurisdiction, to the extent permitted.
General
- If part of these Terms is unenforceable, the rest stays in force, and the invalid part is replaced by the valid term closest to what was intended.
- Not enforcing a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them if the Service is transferred.
- These Terms, the Privacy Policy and anything you confirm at checkout form the whole agreement for the Service.
- Hosting, accounts and payment involve third parties named in the Privacy Policy. Their outages and decisions are outside our control.
